• 12/2019  Caroline A. Edwards spoke on the topic “Proving Hardship” at the Pennsylvania Bar Institute's 2019 Annual Real Estate Institute in Philadelphia, PA. Her presentation focused on meeting the “unnecessary hardship” standard in variance cases, reviewing holdings in relevant Pennsylvania appellate court decisions. Topics included specific physical conditions and circumstances found to meet, or not meet, the hardship requirement; dimensional vs. use variances; the effect of surrounding uses;  financial hardship claims; and de minimis variances. Edwards presented at the 22nd Annual Real Estate Institute of the Pennsylvania Bar Institute in Philadelphia PA on "Regulatory Taking," addressing when the adoption and enforcement of regulations entitles a property owner to compensation as a "taking" of property. Her presentation included a discussion of the key court cases, different types of regulatory takings, and the procedures to be followed in Pennsylvania to bring a regulatory takings claim. Edwards spoke on "Vapor Intrusion" involving the migration of of volatile chemicals from contaminated soils or groundwater into the air inside a building at the Montgomery Bar Association's Realtor/Attorney Liaison Committee meeting in a co-presentation with Peter Porretta, AIA , principal architect with Lighthouse Architecture in Philadelphia PA. Ms. Edwards' presentation included discussion about the regulations and practices affecting vapor intrusion and issues to be aware of when buying and selling property.
